Who Qualifies for an H-1B Visa

What Employers Need to File First

Before anything is filed with USCIS, the employer must complete a few required steps.

One of the biggest is the Labor Condition Application (LCA), which sets out wages, work locations, and working conditions. This must be approved by the Department of Labor before the H-1B petition can proceed.

Your employer needs to provide certain information before you can apply and be approved. For example, they must clearly define the job so that everyone can understand what you will do. They also have to show that they can afford to pay your wages in line with what is advertised for the position.

Your employer will also be expected to defend your qualifications and show why you are a good fit for the position. Essentially, they need to show that the job is what they say it is, and that you are the best candidate to fit that role.

How the H-1B Lottery Works

There’s an annual cap on new H-1B visas, which means there are more applicants than available spots most years.

When that happens, USCIS runs a lottery system to randomly select who moves forward. There is no way to guarantee that you will be selected in that lottery. Your chances are relatively even with everyone else who filed in time to be selected.

Even if you are selected in the lottery, that does not mean that you are automatically approved for a visa. It only means that your application will be processed as usual to see if you qualify for an H-1B visa.

How Timing Affects Work Start Dates

Timing is one of the most frustrating parts of the H-1B process.

Even after selection, processing can take months. Some cases move faster with premium processing, but others get delayed if USCIS requests more information.

Your start date may not come right away. The USCIS has finite resources and can’t process every application at the same time. You may have to wait until the start of the new fiscal calendar for your application to be processed.
