What is the EB-5 Investor Visa?

The EB-5 Visa allows foreign nationals to obtain a U.S. Green Card by making a significant investment in a new or existing commercial enterprise. The key requirement is that the investment must create or preserve at least 10 full-time jobs for U.S. workers.

To qualify for the EB-5 Visa, you must invest either:

$1.05 million in a U.S. business, or
$800,000 if the investment is made in a targeted employment area (TEA), which includes high-unemployment or rural areas.

How Does the EB-5 Application Process Work?

The EB-5 application process can be complex and involves multiple steps:

Select a Qualifying Investment – You must choose a commercial enterprise that meets the EB-5 program’s criteria for job creation.
File Form I-526 – This is the initial petition to prove that your investment meets the program’s requirements.
Conditional Green Card – Once the I-526 is approved, you and your family members (spouse and unmarried children under 21) can apply for conditional permanent residency, which is valid for two years.
File Form I-829 – After two years, you can apply to remove the conditions on your Green Card by proving that your investment resulted in the creation of the required jobs.

How Long Does the EB-5 Process Take?

While processing times can vary, the EB-5 process generally takes between 18 to 24 months from the time of submitting your initial petition (Form I-526) to receiving conditional permanent residency. The time to remove conditions and receive a permanent Green Card can take an additional two years.
