Hollywood EB-4 Visa Lawyers

The EB-4 visa is not a typical employment-based visa. It is meant for certain people who fall into specific special immigrant categories under federal law.

That can make the process confusing at first. Your eligibility depends on which category fits your situation, and the paperwork can look very different from one case to the next. Sukkar & Associates helps people in Hollywood sort out where they fit, what evidence they need, and which immigration filings come next.

Who May Qualify for an EB-4 Special Immigrant Visa

EB-4 is the fourth employment-based preference category for certain special immigrants. It does not have one single set of requirements that applies to everyone.

A special immigrant juvenile, for example, will not have the same eligibility rules as a religious worker. The same applies to others who may qualify under different EB-4 classifications.

In many cases, the process begins with Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant. The evidence required depends on the category you use.

Why You Need Hollywood Family Immigration Lawyers

Simple-Looking Questions With Legal Consequences

Immigration forms often ask simple-looking questions with legal consequences.
An answer about a prior entry, arrest, marriage, or immigration application can change which process is available.

Records Reviewed First

We can review passports, visa records, I-94 history, prior petitions, divorce records, criminal documents, and any notices received from immigration agencies before you file.

Evidence With a Purpose

A lawyer can help you decide which records are useful and which need more explanation. Sending hundreds of pages without a clear purpose does not necessarily make a case stronger.

Responses That Keep Cases Moving

When USCIS or the National Visa Center asks for more information, we can prepare a response that addresses the actual concern and keeps the case moving.

What Can Slow Down or Complicate an EB-4 Petition

Which Special Immigrant Categories Fall Under EB-4

The EB-4 category covers several different groups. Special immigrant juveniles and certain religious workers are among the more common examples. Other possible categories include certain broadcasters, physicians, members of the U.S. Armed Forces, and some current or former employees of international organizations or qualifying U.S. government-related operations. The requirements are very different from one category to another.

A special immigrant juvenile generally needs a qualifying state juvenile court order that includes certain findings required by immigration law. By contrast, a religious worker may need to show qualifying religious work, membership in a denomination, and prospective employment.

That is why the first question is not simply whether EB-4 exists as an option. It is whether you fit one of the categories closely enough to qualify.

What the EB-4 Petition and Green Card Process Involves

For many applicants, the first step is filing Form I-360 with documents that show you meet the requirements for your particular category. Approval of that petition is important, but it does not always mean you can get a green card right away.

If you are already in the United States and otherwise eligible, you may be able to apply for adjustment of status using Form I-485 once a visa number is available. If you are outside the United States, the process may instead continue through the Department of State and a U.S. consulate.

The order of those steps can vary. Some applicants may be able to file certain forms together when a visa is immediately available. Others may have to wait.

How EB-4 Cases Are Reviewed

How Visa Availability Can Affect Your EB-4 Case

EB-4 visas are limited each year. That can create a waiting period even after USCIS approves the underlying petition.

The Department of State publishes a Visa Bulletin every month showing which priority dates are eligible for final action and which applicants may be able to move forward with filing. Those dates do not always move in a straight line. They can advance, stay the same, or move backward.

As a result, a person can qualify for EB-4 and still have to wait before permanent residence becomes available. The timing depends partly on the visa category, priority date, and current availability.

How EB-4 Cases Move Forward

How a Hollywood EB-4 Visa Lawyer Can Help With Your Application

EB-4 cases can get complicated because no single path works for everyone. A lawyer can first assess whether you qualify under one of the categories. From there, the focus shifts to building the petition with the right evidence, filing the correct forms, responding to USCIS questions, and tracking visa availability.

Sukkar & Associates can help you work through each step. If you are considering an EB-4 visa, contact Sukkar & Associates at (954) 922-2836 or through our website for help with immigration legal issues.
